Agreement to these terms

By browsing this website, purchasing a program, or using an evaluation or funded account provided through us, you agree to these terms. If you do not agree, please do not use the site or our programs.

These terms apply together with two other things: the program rules published on this site for the specific program you buy, and the terms of our trading platform provider where your account and purchases live. Where those documents conflict, the program rules and platform terms govern the specific account, and these terms govern your use of the website.

Eligibility

You must be at least 18 years old, legally able to enter into a binding contract in your jurisdiction, and not barred from using trading-related services under the laws that apply to you. You are responsible for making sure your use of our programs is legal where you live.

What we provide

TTH Funding sells notional-funded trading evaluation programs. You trade within a simulated evaluation environment on accounts our trading platform provider creates, and if you meet the program's profit target without breaking its rules, you become eligible for a funded account and profit-share payouts.

We are not a broker, dealer, investment adviser, or custodian, and we do not hold, manage or invest client money. Nothing on this site or in our communications is financial, investment, tax or legal advice, and nothing is a recommendation to buy or sell any instrument. All trading decisions are yours.

Accounts, pricing and purchases

• Programs are purchased through our trading platform provider. Prices, account sizes, platforms and add-on availability are those shown on our Challenges page at the time of purchase.
• Promotional codes are valid only for the program types, platforms, account sizes and dates stated with the promotion. Codes cannot be combined unless we say so, and a discount is not applied to a selection the code does not cover.
• One account is permitted per account size, across all programs and platforms. The total funding available across all TTH Funding markets is capped at $1,000,000 per trader.
• We may refuse or cancel a purchase, and void a discount, where an order exceeds these limits, appears fraudulent, or results from a pricing or technical error.

Program rules

Each program has its own profit target, maximum daily loss, maximum drawdown, time limit, consistency rule and news or weekend-holding restrictions. These are published on the program pages and in the transparency section of this site and form part of your agreement with us.

Breaching a program rule ends the evaluation or funded account and forfeits any fee paid. Prohibited activity includes, but is not limited to, exploiting platform errors, latency or pricing faults, copying trades between accounts you control for the purpose of passing targets, account sharing or selling, and any strategy the program rules list as prohibited. Our platform provider's determinations on rule breaches and account outcomes are final.

Payouts

Profit share, payout eligibility, minimum payout amounts and withdrawal timing are set by the program you hold and shown on the program pages. Payout requests are made through the trading platform and are subject to verification of your identity, your account history and compliance with program rules.

We may delay or withhold a payout while we investigate suspected abuse, a rule breach, a duplicate or fraudulent account, or a payment dispute.

Acceptable use of this website

• Do not use the site for any unlawful purpose, or in a way that interferes with its operation or with other visitors.
• Do not attempt to access administrative areas, client records, or systems you are not authorised to access.
• Do not scrape, copy, resell or republish our content, pricing tables or program materials without our written permission.
• Do not misrepresent an evaluation or funded account as a live brokerage account, and do not present our results as investment advice to others.

Refunds and payment disputes

All sales are final except where the law requires otherwise, or where we are unable to deliver the account you purchased. Duplicate or clearly erroneous charges will be reviewed and refunded where confirmed.

If you believe you were charged in error, contact us first at tthfunding@propaccount.com so we can look into it before you raise a dispute with your bank or payment provider.

Public results and testimonials

By participating in a program you agree that we may publish your first name together with your program type, account size, payout amount and the relevant date on our certificate wall and activity feed. We do not publish email addresses, full names, account logins or payout details.

You can opt out of public display at any time by contacting us, and we will publish you as "TTH Trader" or remove you from public display.

Intellectual property

The TTH Funding name, logo, site design, copy, program materials and graphics belong to us or our licensors. You may view and share links to our pages, but you may not copy, modify or use our branding or content commercially without permission.

Risk disclaimer

Trading Forex, futures and prediction markets involves substantial risk and is not suitable for everyone. Evaluation accounts are simulated, and results in a simulated environment do not guarantee results in live markets. Past performance is not indicative of future results. Never trade with money you cannot afford to lose.

Disclaimers and limitation of liability

The website and our programs are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all implied warranties, and we are not liable for indirect, incidental, special or consequential damages, or for lost profits, lost trading opportunities or loss of data.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to these terms or our programs is limited to the amount you paid us for the program giving rise to the claim in the three months before the claim arose. Nothing in these terms excludes liability that cannot lawfully be excluded.

Suspension, changes and termination

We may suspend or close access to the site or a program where these terms or the program rules are breached, where required by law, or where necessary to protect the integrity of our platform.

We may update these terms as our services change. The date at the top of this page shows when they were last revised, and continuing to use the site after a revision means you accept the updated terms.

Governing law

These terms are governed by the laws applicable in the jurisdiction in which TTH Funding is established, and any dispute will be handled by the courts of that jurisdiction, unless the law where you live gives you the right to bring a claim locally.
